Trespass on the Case, for £300 damages for "Causing said William to be Impressed" in the Rayal Navy and for detaining William's property. Pltf. said that on 1 October 1754 he agreed with deft. to ship as mate aboard the schooner Nancy from Newport "to the port and City of London in the Kingdom of Great Brittain" at £20 "Road Island Currancy" per month. Pltf. said they departed Newport the next day, but at London on 1 February 1755 Crane "caused him to be Impressed on Board our Ship of war Called the Monarch wehre he in our Service was Detained from that time untill the twenty eight of November 1755, and also the said Seth at said Halifax took into his hands and possession on Board the said Schooner the seveall Goods and Marchandize ... belonging to the said William to the amount of Thirteen pounds Eight shillings Sterling money of Great Britain." Deft. pleaded in abatement, (1) that pltf. had "taken two actions in one and the same Writ of a Different Nature, Viz, One for a Tort on his Person and the other for a Detention of his goods"; and (2) the pltf. failed to demonstrate that he ever demanded the goods "that he pretends is Detained." or the amount he was "Damnified by said Detention." Abated. Costs for deft. taxed at [blank]. Appealed by pltf., with sureties as in 34.
